PIL against Himanta: HC seeks case records

GUWAHATI, Sept 10: Hearing the admissibility of the PIL filed by AGP MLA Padma Hazarika seeking reopening and reinvestigation of two cases — one at Panbazar police station (No. 15/91) and the other at Chandmari police station (No. 77/91) — and cancellation of land allotment to Jericho Detergent Pvt Limited, a division bench of the Gauhati High Court comprising Acting Chief Justice Ranjan Gogoi and Justice Amitabh Roy has today sought documents relating to the two cases from the respective police stations and the designated (TADA) court before admitting the case. Both the cases are against Asom Health and Family Welfare Minister Himanta Biswa Sarma and others. The admissibility of the case will be heard again on September 17.

While the case No. 15/91 was for offences under Section 25(1)(A) of Arms Act read with Sections 3 and 4 of the Terrorist and Disruptive Activities (Prevention) Act, 1987, the case No. 77/91 was for offences under Sections 10, 11, 12 and 13 of the Unlawful Activities (Prevention) Act, 1987 read with Sections 3 and 4 of TADA.

Senior Supreme Court advocates Bhaskar Pradhan and YD Jesso and Gauhati High Court advocates Tarun Chutia and Bandana Deka argued for the petitioner today. THE SENTINEL
