What prompts ex-Bihar MP to withdraw case against Himanta?

GUWAHATI, Aug 26: The case against Asom Health Minister Himanta Biswa Sarma and five others (PIL 59/2009) filed by former Bihar MP Shukhdeo Paswan has taken an interesting twist in its hearing today when the complainant expressed his willingness to withdraw the PIL only to get a straight directive from the division bench of the Gauhati High Court that the complainant has to justify in no uncertain terms as to why he is willing to withdraw the case. The division bench comprises Acting Chief Justice Ranjan Gogoi and Justice BP Katakey.

In the last hearing of the case on August 19, the High Court had asked the complainant to file a counter-affidavit. The High Court had also asked Chandmari and Panbazar police stations to send in closed envelops details of the cases against Sarma filed in their respective police stations to the High Court.

The division bench of the High Court heard the case today when the complainant, Shukhdeo Paswan, expressed his willingness to withdraw the PIL against Sarma and others through his counsel. In a letter sent to the High Court through his advocate, the former Bihar MP said he is satisfied with the affidavit filed by Sarma and five others and that he came to know many facts regarding the cases against Sarma that were not known to him earlier. He requested the High Court to withdraw the PIL filed by him against Himanta Biswa Sarma and others. Himanta Biswa Sarma and others filed an additional affidavit in the High Court yesterday. The bench has, however, asked the complainant to justify as to why he is willing to withdraw the PIL filed by him. The bench has asked the former Bihar MP to exactly pinpoint as to what he got in the affidavit that made him decide to withdraw the PIL against Himanta Biswa Sarma and others.
